Welcome to LearnFrenchWithJen/learnfrenchwithjen.com (“the Website”). This Website is owned and operated by Jennifer Asada operating as a sole trader in Ireland trading as "LearnFrenchWithJen"

By purchasing a membership on this Website, you (the "Member", "Student", or "Parent/Guardian") agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before completing your payment.

1. Eligibility & Guardian Consent

• Digital Age of Consent: In accordance with Irish data protection laws, the digital age of consent is 16.
• Under 16s: If the student accessing this site is under 16 years of age, a parent or legal guardian must complete the checkout process, manage the account, and explicitly consent to these terms on behalf of the minor student.
• Account Responsibility: The individual named on the billing account is responsible for all actions taken by the user of that account.

2. Paid Memberships & One-Off Fixed Term Access

• One-Off Payment Model: Access to LearnFrenchWithJen's community site, French Oral resources, pre-recorded modules, and live calls is granted on a one-off, upfront payment basis for the duration of the current academic school year.
• No Automatic Renewal: This is not a recurring subscription. Your payment method will only be charged once at the time of purchase. You will not be billed automatically for subsequent academic years.
• Pricing Variability: The one-off purchase price is subject to change at our sole discretion. Promotional rates, early-bird pricing, or mid-year discounts may apply at different times throughout the year. The price applicable to your membership is strictly the price displayed at the exact moment of your checkout transaction. Retroactive refunds or discounts will not be applied if pricing drops or alters after your purchase.
• Access Timeline: Your access to the platform, resource vault, and live member area commences immediately at the exact time your purchase is successfully processed. Regardless of your sign-up date (whether at the start of the school year or mid-way through), your membership term and platform access will automatically terminate and expire on the 30th of June following the completion of that academic year's state examinations.

3. Immediate Digital Delivery & 14-Day Cooling-Off Waiver

• The Rule: Under EU Consumer Protection Regulations, you normally have a 14-day statutory right to cancel a digital service.
• The Waiver: By completing your purchase and instantly gaining access to our library of pre-recorded videos, audios, and oral templates, you explicitly request immediate performance of this contract. You acknowledge that you waive your right to a 14-day cooling-off/cancellation period once digital content delivery has begun.
• Non-Refundability & Pro-Rata Clarification: Because full, unrestricted access to the complete digital syllabus materials is granted immediately upon payment, all one-off fees paid for the school year membership are strictly non-refundable. Furthermore, because access terminates globally on the 30th of June, fees are not subject to pro-rata reductions or partial refunds if a student signs up later in the school year.

4. Intellectual Property & Anti-Sharing Policy

• Proprietary Content: All videos, audio tracks, sample oral answers, notes, and templates hosted on this platform are the exclusive intellectual property of LearnFrenchWithJen
• Single-User License: Your membership grants a single, non-transferable license for one individual student’s personal study.
• Strict Prohibitions: You are strictly prohibited from:
• Sharing your login credentials (username and password) with schoolmates, friends, or third parties.
• Downloading, ripping, or screen-recording our video/audio assets using external software.
• Redistributing, publishing, or selling our notes, sample answers, or templates.
• Enforcement: We use automated security tracking. Simultaneous logins from multiple locations or excessive IP switching will trigger an automatic account suspension. Violations of intellectual property will result in immediate termination of access without a refund.

5. Dynamic Content, Updates, and System Modifications

• Continuous Evolution: To ensure our resources remain highly relevant and fully aligned with any current developments or trends in the official Leaving Certificate French syllabus, the content inside the membership area is dynamic and evolving.
• Regular Additions: We actively create and upload new resources—including but not limited to fresh video tutorials, audio practice drills, sample oral questions & responses, topical vocabulary cheat sheets, and live call replays—on a regular basis throughout the academic school year.
• Right to Modify or Replace: We reserve the right, at our sole discretion, to modify, update, refine, or remove existing content within the member portal at any time without prior notice. This includes updating old audio clips for clearer pronunciation, replacing older written templates with higher-scoring alternatives, or adjusting the layout of the materials.
• No Guarantee of Permanent Static Assets: Your purchase grants you access to the evolving resource ecosystem as it stands on any given day. You acknowledge that specific individual resources may be modified or phased out to make room for superior, updated materials, and that such updates do not entitle you to any refunds or alternative compensation.

6. Interactive Social Ecosystem, Profiles, and Community Guidelines

• User-Generated Content: Our platform features social community elements, including student user profiles, direct messaging, activity feeds, personal profile images, and user stories ("User-Generated Content"). You retain ownership of what you post, but you grant us a royalty-free license to host and display this content inside the secure member network for the duration of the school year.
• Strict Profile Rules for Minors: Students under 18 have the option to set a profile image and display name. Profile photos must be appropriate (no offensive imagery, political symbols, or revealing clothing). Display names must not mimic or impersonate another student or staff member.

• Prohibited Conduct: We operate a zero-tolerance policy for toxic behavior. Members are strictly prohibited from posting, sharing, or messaging content that is:

  • Defamatory, abusive, bullying, harassing, or intimidating to other students.
  • Sexually explicit, inappropriate, or harmful to minors.
  • Unrelated to the Leaving Certificate French syllabus (e.g., spamming, advertising, or trying to sell items to classmates).
• Our Right to Moderate and Delete: As the platform operator, we actively monitor and moderate the community feed, stories, and profiles. We reserve the absolute right to instantly edit, blur, block, or permanently delete any post, story, image, or profile that violates these standards without prior notice.
• Immediate Termination & Escalation: Severe breaches of these community rules, including the online bullying of another student, will result in the immediate termination of your membership without a refund. Where a child safety concern or cyber-bullying incident is severe, we reserve the right to report the matter to the student's parents, their secondary school principal, or An Garda Síochána if legally required.

7. Live Internal Calls & Video Recording Waiver

• Call Purpose & Location: Live workshops and interactive sessions take place directly inside the gated member portal.
• Resource Replays: To provide maximum educational value, live sessions can be recorded by the host and posted into the student resource vault as a permanent study tool.
• Privacy Controls:

Students are *never required** to turn on their webcams or microphones.

• If a student chooses to activate their camera, unmute their audio, or use their real name in a live interactive workshop, they (and their parent/guardian) explicitly consent to their voice, likeness, or display name being captured in the permanent recording.
• To participate completely anonymously, students must leave cameras off, keep microphones muted, change their display name to a first-name-only pseudonym, and interact strictly through the typed text chat.
• Community Privacy: Members are strictly prohibited from screen-recording, screenshotting, or sharing clips of other students participating in live calls on public platforms (including but not limited to TikTok, Snapchat, and Instagram). Breach of this privacy rule will result in a permanent, non-refundable lifetime ban and may be reported to relevant authorities.

8. Disclaimer of Educational Guarantees

• While all resources are meticulously designed to align with the official State Examinations Commission (SEC) syllabus for the Leaving Certificate French oral exam, we do not guarantee specific grades or examination outcomes. The ultimate exam performance relies entirely on the individual student's application, study habits, and independent performance on the day of testing.

9. Limitation of Liability

• As a sole trader operating in Ireland, Jennifer Asada’s total liability to you for any claims arising out of your use of the website or live tutorials shall not exceed the total amount of the membership fee actually paid by you.

10. Governing Law

• These Terms and Conditions are governed by and construed in accordance with the laws of Ireland. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the Irish courts.
